Latest PS3 update goes live with version 3.72. PS3 gamers can now download the new update, which won’t take long to install. Don’t expect any major changes in this update; it’s just a few tweaks that will help improve network stability.
However, a number of PS3 gamers are worried about changes to the Terms and Conditions with this new update.
In the new update the Terms and Conditions have also been changed, which might change an individuals legal position with the PSN and Sony.
The change reads as below:
“Any dispute resolution proceedings, whether in arbitration or in court, will be conducted only on an individual basis and not in a class or representative action or as a named or unnamed member of a class, consolidated, representative or private attorney general legal action, unless both you and the Sony entity with which you have a dispute specifically agree to do so in writing following initiation of the arbitration.”
This is perhaps a reaction from Sony due to the PSN hacking incident, and to help protect Sony from future mass lawsuits.
Can you oppose this? Yes. You can send a letter to the following address within 30 days after agreeing to the terms:

In the letter you should put your address, PSN username, and PS console serial number. You should then make it clear that you don’t agree or support any disputes through arbitration.
